Customers should, where practical, advise UpwardTech if their device contains particularly sensitive or confidential information.

5. Passwords and Access Credentials

Some services may require access credentials, passwords, PINs or authentication information.

Where credentials are required, UpwardTech may request them solely for the purpose of providing the requested service.

Customers are encouraged to:

  • Provide temporary passwords where possible;
  • Change passwords after the completion of a service where appropriate;
  • Avoid providing passwords that are not necessary for the requested service; and
  • Use separate passwords for important accounts.

UpwardTech will not intentionally use customer passwords or credentials for purposes unrelated to the service being performed.

Where credentials are recorded for operational purposes, UpwardTech will take reasonable steps to protect them and remove them when they are no longer reasonably required.

  • Antivirus or security software;
  • Manufacturer diagnostic utilities;

  • Crash reports;
  • Hardware monitoring tools; and
  • Other legitimate diagnostic software.

Where possible, diagnostic information will be limited to information relevant to the requested service.

UpwardTech will not intentionally inspect personal files, photographs, emails or other private content unless doing so is reasonably necessary for the requested repair or the customer has expressly authorised such access.

9. Data Recovery Services

Data recovery services may require access to storage devices and the data contained on those devices.

By requesting a data recovery service, you acknowledge that technical access to the storage media may be necessary to determine whether data can be recovered.

UpwardTech will take reasonable steps to protect recovered information and restrict access to authorised personnel.

However, due to the nature of data recovery, UpwardTech cannot guarantee that:

  • All data can be recovered;
  • Recovered files will be complete;
  • Recovered files will be usable;
  • Data will not be corrupted; or
  • The original storage device will remain functional.

Customers are responsible for ensuring they have appropriate backups of important information.

Customers should notify UpwardTech if there are particular files or categories of information that should not be copied.

11. Customer Responsibility for Backups

Customers are responsible for maintaining appropriate backups of important information.

While UpwardTech may offer backup and data recovery services, we do not guarantee that data will always be recoverable following:

  • Hardware failure;
  • Software failure;

  • Theft;
  • Fire;
  • Flood;
  • Power failure;

Customers should maintain independent backups of important information.

This may include:

  • Transaction details;
  • Invoice information;
  • Payment method;
  • Amount paid;
  • Transaction date;
  • Customer name; and
  • Other information required for accounting purposes.

Where payment is processed through an external payment provider, payment information may be handled directly by that provider under its own privacy policy and security practices.

UpwardTech does not intentionally retain complete credit or debit card numbers unless reasonably necessary and legally permitted.

  • Referring website;
  • Pages visited;
  • Date and time of access;
  • Approximate geographic information;
  • Website interaction information; and
  • Other technical information generated during website use.

This information may be collected through server logs, cookies, analytics services and similar technologies.

Cookies may be used to:

  • Maintain website functionality;
  • Remember preferences;

  • Measure website traffic; and
  • Improve our online services.

You may be able to disable cookies through your browser settings. Some website functionality may not operate correctly if cookies are disabled.

Where third-party services are used, UpwardTech will take reasonable steps to select providers that provide appropriate security and privacy protections.

15. Disclosure of Personal Information

UpwardTech will not sell your personal information.

We may disclose personal information where reasonably necessary for the purposes described in this Privacy Policy.

16. Disclosure of Information to Overseas Recipients

Some technology, cloud, software, payment, hosting, communication and other service providers used by UpwardTech may operate outside Australia.

As a result, personal information may potentially be stored or processed outside Australia.

The countries in which information may be processed will depend on the providers and services used by UpwardTech at the relevant time.

Where reasonably practical, UpwardTech will take appropriate steps to assess the privacy and security practices of relevant third-party providers.

Because the providers used by a technology business may change over time, UpwardTech does not represent that personal information will only ever be stored or processed in Australia.

17. Security of Personal Information

UpwardTech takes reasonable steps to protect personal information from:

  • Misuse;
  • Interference;
  • Loss;
  • Unauthorised access;

Accordingly, while UpwardTech takes reasonable security measures, we cannot guarantee the absolute security of personal information.

Remote support may require UpwardTech or an authorised technician to connect to a customer's computer using remote-access software.

During a remote support session, a technician may be able to view:

  • The customer's desktop;
  • Applications;
  • System settings;
  • Error messages;
  • Files or folders visible on screen; and
  • Other information accessible through the remote connection.

Customers should close private applications, documents and websites that are not relevant to the support request before allowing remote access.

UpwardTech will use remote access only for legitimate support purposes.

Remote access sessions should be terminated when the requested service has been completed.

20. Third-Party Software

Computer repairs may require the installation or use of third-party software, including:

  • Operating systems;
  • Security software;
  • Diagnostic software;
  • Remote support software;
  • Drivers;
  • Manufacturer utilities;
  • Backup software; and
  • Other applications.

22. Referral Programs

UpwardTech may operate customer or business referral programs.

Where a customer refers another person to UpwardTech, we may collect information necessary to identify and process the referral.

  • Process the referral;
  • Provide referral benefits;
  • Maintain referral records; and
  • Prevent fraudulent or duplicate referrals.

23. Retention of Personal Information

UpwardTech will retain personal information only for as long as reasonably necessary for the purposes for which it was collected, unless a longer retention period is required or permitted by law.

Customers remain responsible for ensuring that important personal information has been backed up and removed from a device where appropriate.

Where practical, UpwardTech may securely erase storage media before disposal or reuse.

However, customers should not rely solely on UpwardTech to remove sensitive information unless secure data destruction has specifically been requested and agreed upon.

UpwardTech takes reasonable steps to ensure that personal information we collect, use or disclose is accurate, complete and up to date where appropriate.

Customers are encouraged to notify us if their information changes.

If you believe that information we hold about you is inaccurate, incomplete or out of date, you may request that it be corrected.

26. Accessing Your Personal Information

You may request access to personal information that UpwardTech holds about you, subject to applicable laws and any relevant exceptions.

Requests should be made in writing and should include enough information for us to identify you and locate the relevant information.

We may need to verify your identity before providing access to personal information.

Where permitted, we will generally provide access in a reasonable timeframe.

In certain circumstances, we may be unable to provide access or may provide only limited access where permitted or required by law.

If access is refused, we will generally explain the reason for the refusal where permitted.
